When I do a search on our companies name is google another company seems to be bidding on our company name as a keyword in their campaign. It's the only ad that appears and they are a competitor of ours. Is this right? Should they be allowed to do this?

From Google's perspective, if it's TM, they can use it as a keyword, but not in ad text, if you've submitted your TM to AdWords' TM team.
On another side, you can approach that company directly and seek for a settlement, explaining that it would be better if you both stay out from your TM space.
It’s a pain, especially for well established names that get lots of searches every day.

I typically fight these things by running an ad carefully worded to say that we're the real deal, don't be fooled by substitutes - that sort of thing.
