My widget company is selling a franchise to another company in another fairly near location which has its own pre-existing adwords account. They will trade now under our name and we will link to each other's websites. Would we now be in breach of Google's terms of service if my ad goes to my site and his ad goes to his site? It is possible that both ads would appear simultaneously.

It sounds like a grey area to me. I think you should contact Google in the first instance and come back here if that doesn't solve the problem for our less-than-informed conjecture.

Well from what I understand, if the domains are different then there shouldn't be a problem? I run a client centre with several accounts which sell similar widgets for different companies using different domains but 2 or 3 of the companies are linked with each other in terms of ownership. If that makes sense to you. This shouldn't be a problem but if you have any worries then it would be best to just pop adwords an email.
