Ads showing despite banned trademark word

How are some advertisers getting round this?

A brand name keyword was banned a few days ago, but two advertisers still have ads showing. One is an affiliate of the trademark owner (via a third party) and another is a retailer.

A similar two-word term was also banned but five advertisers have somehow got round this - the same two plus three affiliates of other companies.

Any ideas why these ads are still showing?

Google will let you use trademarked terms if you can prove that the trademark holder has authorized you to do so.

If, when you say 'banned', you mean that you had that keyword disapproved during editorial review - and if you feel that the disapproval was incorrect, then by all means respond to the email that you received and explain why you feel that an error was made.

On the other hand, the advertisers you mention who are still running may fall within the trademark owners stipulations, while you fall outside. The only way to know this with precision, is to have the trademark folks at AdWords look at your ads/keywords individually.

Trademark policy can be quite complex, as it depends on what the trademark owner has stipulated (and not stipulated), and in which countries their name is trademarked - and every ad is reviewed on a case-by-case basis.

On this second page, you'll note that there are different procedures for Trademark rights in the US and Canada, and Trademark rights outside the US and Canada.
