It is a very good position for us (might not be for all business modesl). The CTR is much higher there.
In many business models however, the ROI might be lower.
They put the highest ranked ad (which may NOT be the highest bidder) who ALSO meets an undisclosed max bid threshold.

One thing though - the info quoted above is not really correct. The ads that go to the top do have to meet an additional performance standard, but it is not related to Max CPC. Instead, it is related to CTR.
In other words, the ads that go to the top are sent there because they are more relevant to Google users, not because they have a higher Max CPC.
Also, actual CPC is weighted rather than Max CPC in terms of going to the top. This is different than the ads on the right hand side where positioning is determined by Max CPC x CTR.
