AdSense: Tax Forms... PLEASE HELP

Which Tax form do I fill out?

Hello Everyone,
I have been serving AdSense ads on my site for about a year or so. Recently my payments were put on hold, they said that I filled out the wrong form and that I need to correct this and resend. The problem is, I have no idea which form I fall under. Can someone please help me?

I am NOT a U.S. person (for example a U.S. corporation, a U.S. partnership, a U.S. citizen or a U.S. resident alien). I was born and still reside in Canada.

The part that I am confused about is when they ask: Do you have U.S. Activities related to your participation in AdSense?

They list the following as a US activity: Having employees in the U.S. who are involved in either: setting up your web server, hosting service, or website .
But they go on to write that: "Generally, using an unrelated third-party United States (U.S.) web hosting service to host your web pages, renting web servers that are located in the U.S. from an unrelated third party, do not of themselves constitute U.S. Activities. "

That is what is throwing me off.

I don't have any US employees. I did all the work on my own for my website (purchase/setup hosting, web design, marketing etc...) BUT, the hosting company in which I purchased my virtual hosting package is located in the US. Does that constitute as US activities or not?

If anyone can help me out, it would be really appreciated. I am even willing to pay someone for their time/advice... I am at my wits end about this!

No, you should be fine as not filing a form. I am in the exact same instance as you, and I have had no problem. It is only if you own the web server and hardware in the US.

In fact, it says on the filing page:

Generally, using an unrelated third-party United States (U.S.) web hosting service to host your web pages, renting web servers that are located in the U.S. from an unrelated third party, or having your payment sent to a U.S. Post Office Box or mail forwarding address, do not of themselves constitute U.S. Activities.

That is what I thought... but all of a sudden they are saying that I need to fill out another form. I asked several times for help since I had no idea what I did wrong but they weren't helpful at all.

Anyways, thank you for your help. I am going to sign the non-us, no us activities thing and leave it at that!
