Large ads above the fold on mobile

Hello,

recently after 3 years I received site-level violation regarding "Large ads above the fold on mobile"
My site is not responsive and is like 900px wide .... and I used 336x280 ad on the right-top side of my page layout.

I just removed this ad for all mobile devices just to be sure. But I think site violation strike was not necessary in my case because the ad was not visible for mobile devices ( users had to scroll to the right to actually see it)

What is your opinion on such strike?

Also do you think I can place small mobile banner 320x50 on the very top-left of my page instead without risking additional violation?

Then it was visible.

Often we need to consider what Googlebot sees, even if it is not what we see.

As mobile continues to dominate the internet, this will only become more standard.
