DMCA Violation Account Disabled

What Can I do?

Ok guys this happenned minutes ago and its as if my life is flashing before me. In August I got an email citing that I had a DMCA notice. I saw the page and removed the content. I didnt file a counter claim.

Now I just got the adsense account disabled email but what shocks me is that it didnt even give me a chance.

I totally shut down the website but the worst thing is that the I dont know what is going to happen.

I have 130 websites in this account, this one website was not even making 2.00 a year. I sent in the appeal and explained that the webmaster I had at the time duped me into this free content thing and all i had to do was to give up links to other sites and I would get original content.

Now I am like going crazy, Its a lot of revenue and just a few days away from PIP.

Here is what the email said

The DMCA is a United States copyright law that provides guidelines for
online service provider safe harbor in case of copyright infringement.
Since we did not receive a counter-notification from you within 10 days,
we have disabled your AdSense account at this time.

Because your account has been permanently disabled, we will withhold
payment of your account balance. As stated in the AdSense Terms and
Conditions, Google reserves the right to withhold payments from publishers
due to any breach of the program agreement.

If you have legal questions about this notification, you should retain
your own legal counsel. If you have any other questions about this
notification, please let us know.

I need to know if I can reapply?
I need to know if all the sites in my account cant use adsense anymore?
What is the best action, do I wait on a reply from them?
Has anyone ever recovered?

I need help! Can someone answer these questions?

Well the email text is likely to get deleted, but anyway.

There used to be a couple threads around here about sites that got reinstated, and what was involved. Have you tried searching for them?

That's about all we can do.

Yea I don't think there's anything anyone here can do. If you're supposed to respond in ten days and didn't... all you can do is try to talk to Google. Find that URL that ASA posted about questions about policy and try that, or hit up the AdSense Help forum and see if you can get the attention of one of the Google employees there. Sorry we can't be more help. We're just a bunch of users. You need a Google person.

The "chance" was given back in August ..like netmeg says you should have replied and or /explained

explained that the webmaster I had at the time duped me into this free content thing and all i had to do was to give up links to other sites and I would get original content.

It's not how many sites in the account ( although all your eggs in the one basket ..and letting outside webmasters carry the basket is begging for trouble )

<aside> why are so many people in webmasterworld down the years not actually their own webmaster ..it does say webmaster ..not websiteownerworld..like being in a car mechanics club and saying some other guy does the spanner work I just own the thing and take the prize money ..it isn't the same thing ..and IMO it's not very businesslike at all to trust what you live off to someone elses "spannerwork" ..it can only end in tears ..or maybe it's just me </aside>

It's a private commercial contract between you and them ..anything any of us say isn't going to change that ..there are no magic shields against "the email".

They tell you that maybe you should retain counsel.
Your choice..( expensive ) never heard around here that getting a lawyer worked for anyone who got "the email"

You have contacted them ..presume this is what you meant by sent an "appeal"

Yes but re-applications are usually replied to with a a "form letter" "No" at best ..or ignored.

They disable the account ..not just one site ..so you can't use adsense anywhere ..your sites will be all showing "adsense cannot be reached" ( paraphrase ) in all ad spots on all pages that had adsense...if they aren't all doing so yet they very rapidly will be .

What is the best action, do I wait on a reply from them?


You can't do much else ..except try to think of a plan B to monetise your sites

I only ever use my own created stuff, text, images, photos, graphics, videos, the whole nine yards and got and still occasionally get ripped of by really determined scrapers and those who "help themselves" so like many here I have strong opinions on copyright .. and send the occasional DMCA...works IME .

I need help! Can someone answer these questions?

Lots of people can answer them ..only Google's answers count.

yes you can recover your account if you make all your site original and very high quality content. Google is very kind, its we people don't behave properly.

In the past, maybe. But now it's about impossible for Google to listen to a sob story and change its mind. It's more machine than man.

I know of one site that had way more adsense blocks that were allowed, and were asking people to click on their adverts. They got banned, then reinstated ! And to top it off, they were breaking the TOS again. Again they were reported, and now are playing by the rules. Go figure.

Newborn,

Switch to another adnetwork ASAP. Try in text, or another context advertising program in those google ad spots.

Consider selling some of the valuable property that do not violate DCMA, or partner with someone on those properties "ie they take ownership, use their Adsense account, and split profits with you". -- Make sure they are sites that don't voliate google terms. your adsense account was banned but those no other sites are fine with a new owner.

Always use an adserver - "middle man" when dealing with multiple properties and Adsense "or any network". Openx has a free open source Adserver, and Google has free DFP. Set that up on one domain, and push ads to all the other site. that way in the future you can easily switch your ad spots to another network.

I would do all that for now and pursue re installing your account.

Don't let that traffic go to waste, they are a few good Adsense replacements out their.

Ultimately you are responsible. The above excuse isn't going to work, drop it.
