Maybe "deactivation" simply means that you will no longer get paid. Maybe it is no problem for Google, if you continue to run Adsense ads. Maybe it remains up to you, whether or not you want to work for Google for free.
I too, know of a "deactivated" site, which continues to run Adsense. Perhaps a percentage of webmasters get disgusted, lose interest, and just leave the ads up. Maybe Google counts on this. Why should Google do anything, when they are making EVEN MORE money than before (their cut PLUS your cut)?
I believe that Google is breaking the law, by continuing to run adsense ads on sites that they have "deactivated". When one puts up Adsense ads, I believe that there is an "implied contract", consisting of the TOS. I believe that in contract law, there IS NO contract, if there is no consideration. One party to a contract may not continue to benefit from an agreement, which THEY THEMSELVES terminated, in which there is NO CONSIDERATION for the other party. I'm not an attorney, but I remember something like this from a contract law class I took.
Even if this practice does not violate California contract law, this is most certainly a violation of ethics. I thought that Google had an "Ethics Department". Where is it?
