Clarification on a point in the Adsense FAQ

Multiple ad units may be displayed on each Web site page, but no ad unit can contain any advertisement in common with any other ad unit.

Since we don't control the 'ad units', how can we be responsible for ensuring duplicate ads aren't displayed among ad units?

I have two ad units on my page and I'm getting ad duplication. Am I in violation of the TOS? The ad units are different formats. One is a 5 high skyscraper, and the other is a banner with 2 ads.

you cannot have 2 adsense ad units running on the same page.
