Is testing for certain situations (like the time of day or referrer) and choosing to display or not to display AdSense within the bounds of the Google AdSense TOS?

I don't think you will have any trouble with this. The only one might be technical as you might be putting a layer between the content and the adsense ad {the ad serving software} and this might cause a problem with the targeting.
If you can integrate it seamless, you should not have a problem. There is no exclusivity agreement with Google. They get as much or as little of your inventory as you want to give them.
