Is <Title> = <H1> considered Spam by Google?

hi friends,
I am bit confused as i had read somewhere that if my Title of the Page and my <H1> tag are same then it is condisered as SPAM by google. I want to know till what extent it is correct.

I like ur spirit to encourage me to carry on with my thread.

Ok let me come to point now. if u go to <snip>. This site the best example TOP SERPs.
Let me explain you how. If u type search term <snip> then it is coming at the top ,(including mine also) in TOP 10 sites.
IF u type Search Tem= <snip> then also it is coming at the top (including my site also) in TOP 10 Sites.

But if u just type Search Term= <snip> then also it is coming up in Top 10 sites but my site is no where in 20 pages.

Now my question is that it is not just with one model of phone but with every combination of mobile phones it is coming up in Top 10 sites.

And i want to know what is the key reason behind this. I mean if it is coming up in few models or few keywords then it is ok, but why it is coming up in TOP 10 sites for all the mobile accessories related things for all model phones of Nokia,samsung,motorola,siemens etc. etc...
So please if anyone can answer me , moreover if any member wants more clarification about my query then i am happy to give more clarification. Please help me out in knowing the KEY TECHNOLOGY which this site had implemented.

i know it is positive and very much worth while for my competitor. thats why i am asking , what is the key factor in there site which they have impemented or which i am not aware of.

There are too many factors to analize so one can never totaly be sure. That said, other things being equal, I bet your competator has more backlinks than you, better backlinks, or both.

The two guys that started Google, may know it. The Kalman Filter is an empirical Bayesian method. As far as I know it supposes that the noise is normally distributed. That noise may be spam. The Mazrieliez (spelling?) filter does not. One thing is sure, you will never know that filter.

Even in hierarchical bayesian methods, there is a kernel of subjectivity.

Russian statisticians should be more competent in this era. Are there any here?
