I am using some translation software to translate pages into four languages, and the file names are the same as the original english files just in different directories. this way the link structure doesn't have to be messed with.
Do you think google has some penalty for file names being the same, maybe thinking it is duplicate content, which in a way it is?

Google may not have a penelty for it, but i would suggest you to translate the filenames too.
