From what I read on the new payment terms (IF I am reading it right, check me if not), if a click comes from someone with javascript disabled you could lose your google adsense account over it.
How on EARTH are we supposed to know or control that?

I think you better read the TOS again. It doesn't say anything about having your google adsense account closed because someone has javascript disabled. What they did say is that they may not pay your for those clicks.

When your browser send a request to a web server (like the AdSense servers) it declare if Javascript is enabled or not. If Javascript is not enabled, than there is something wrong, because AdSense ads are serving only by Javascript. Ads text, i.e., can be copied and converted in text. If arrives an AdSense request with JS disabled, cannot come from a genuine AS ad. So, for sure, it is a fraudolent click!
