Is this considered 'bringing attention to the referral?'

A referral in a 'internet explorer warning bar' look...

I would THINK this would be considered bringing attention to the referral, but I have no clue.

To be more specific, when there is a popup blocked by IE, or an update detected, a 'warning bar' comes down from and stays at the top of the page in a fixed position.

The code which I am using, isn't quite like that, but pretty close. It's CSS in a div with a 'warning' image to the side in a fixed position.

Currently I am using it with a regular firefox referral, but would like to use the Google Referral Text to generate some revenue. Is this acceptable? And if it is, could something like 'Please upgrade your browser' go before the google text?

I'm a little confused on the TOS for referral texts. Can words not be near it/above it, like Google Adsense, or can we 'encourage' users to download it?
