Are photos w/no text considered "content"?

Someone registered a .com which is identical to that of a client's, except one letter is missing (but there's no mistaking it: they registered it with the hopes of getting visitors who mispell my client's domain, which is very common). When asked nicely if they would sell the domain name, they refused.

The domain forwards to a page with only 5 photos and no text, scattered across the page are adsense ads. So I'm wondering if this person is violating G's TOS since its a one-page site with no text, no information, just a handful of photos.

I'd rather not have my client shell out 3k to an internet lawyer to acquire the domain name, but if this guy's site violate's the Adsense TOS, at least I can drop the hammer on him if he doesn't want to sell.

Photos are considered content, but if it is 1 page, it might be on the line as a MFA. I hate those people registering typos and adding/removing a s, I have to pay twice as much just so I can protect my domains.
