Is Google breaking their own policies?

Extract from their policies page:
"In order to avoid associations with copyright claims, website publishers may not display Google ads on web pages with MP3, Video, News Groups, and Image Results."
[google.com...]

Yet they show ads on their groups.google.com - example:
[groups.google.com...]

Or am I missing something?

Let's put it this way: Putting the ads there was google's deliberate choice that they have probably evaluated carefully, whereas some random adsense publisher doing so on his mp3 site could go either way legally and they don't have time to take a look at it for him. /wild guess

This is not about "MP3" it is about the "News Groups" part.
