Anchor Tags With No Link Text

Are anchor tags void of link text considered spam?

I have come across a page that uses flash for most of the internal links which means SEs can’t follow them. In an attempt to get the SEs to see the rest of the site, the author placed empty anchor tags at the top of the source:

<a href=/about-us.html></a>
<a href=/support.html></a>

Despite the fact that this is just not good SEO, does anyone have any thoughts as to whether or not SEs will consider this spamming? Will they follow the links?

I think it's spam. Because.. what are you linking for? What are the benefits for users?

It's clearly a trick, and someday could be penalize
