How to get back after September 22? DMCA?

One of my websites lost practically all Google traffic on 22nd September and there are no signs of it getting back. The filter is the strongest I've ever seen. It ranks last for all searches. If I search for the domain name "www.mydomain.com" my site is last of the 9 results displayed. Sites above me have a link to my site. Even MC's blog ranks above me because I mentioned the url in one of my comments.

If I search for unique text phrases I'm nowhere and I can sometimes see spam pages from other domains. These pages have scraped Google search results and contain my page descriptions. They are listed as supplemental but they still rank above me.

Is it possible that my site is under a duplicate content penalty? If I remember correctly the September 22 filter was a dupe content filter because adding filter=0 to the url brought the dropped sites back.

I emailed Google and they sent me instructions for a DMCA complaint. I had a closer look at the sites that had text from my page and it seems like they haven't accessed my site but taken everything from Google search results. Should I still do a DMCA complaint?

I was hoping to get my site back during the Jagger updates. I did get one 9/22 site back in Jagger 1 but not this one. I am very frustrated because this site in question is 100% clean.

I could move the pages to another domain and make some changes to the template and content but I still want the original back. I’m paying a higher price for the domain (specific for my country) and webserver.
