If you own the copyright. Issue a DDMA notice to Google against the site that is ranking higher than you.
Yea, that will help...Google couldn't care less, they will send you that stupid form letter about ranking in Google, yada yada yada and send you on your way. I have given up
trying to write them, or Googleguy, he appears to have become insignificant as well.
Because of this I have now independently registered my site content so that I am better protected next time. Its disheartening when you spend a day getting some copy looking good and then a competitor just comes along and copies it, why bother.
do a search on copyright service uk, should be obvious who i did it. it is not a legal registration though, just 'independent' evidence that at this date you did in fact have this content.
note that I am not sure about the benefits, i would not likely get any damages because my content is not valuable but I did it just so that if i have to write another dmca to google, I can include this as independent evidence of ownership. If you already have a problem it wont help because the registration is dated of course.
i used httrack to get my site running on a cd and wrote a program to blank any images that were not really mine (per se).
