However, there is a company called "State Widget Guide" that is a practicing registered business in my state. They make a print only widget guide, and have NOT registered the domain that corresponds with their name. Their website is just a 1 pager.
I see an opportunity doing what they do on the web. My intentions are good, and the site will be a real guide, not a squatter page. I can't deny that I may benefit somewhat from having the same name because of name recognition.
1. Am I violating any laws?
2. Could I lose the domain in court?
3. How should I represnt myself in conversation? (My name is ____ from _______?)
4. Should I try to partner with the magazine, or just do my own thing?
Business law often varies from State to State so it's important that you talk to a local lawyer, one knowledgable in business law in your State.
Your best deal might be to share data and profits with the existing company, offering the company your web expertise.
It's important that you work this out before you get started because some business owners do not fire a warning shot when their rights or interests have been tread upon. Some aim right for the wallet.
