I`m planning to start up an ecommerce business. I live in Toronto, Canada.
I bought all the extensions of the domain name (business name) in question (.com,.net,.org,.ca etc...)
99% of my clients will be in US. I checked US trademark office and my domain (and business name) wasn`t registered.
However, someone has the same trademark in Canada. (It`s not a legitimate business, just a person. But I don`t want to contact him since my business will focus on US market)
Do you think I can have this trademark in US and run my business under this name? Any recommendations?
Thank you in advance.
Legal opinions by webmasters are worth as much as webmasters can charge for giving legal advice: $0.00.
Also, the WW TOS advise that seeking or giving specific legal advice is a bad idea.
You've got a dual jurisdiction issue so I'd suggest locating a larger law firm in a major border city where you are more likely to find the needed expertise.
