Hope your guys can help me. I looking to exchange links but would like some advice before i proceed.

1. When exchanging links with other websites, will i get penalised by Google or even get banned if the other site uses spam.

2. If the answer to question 1 is yes, it there a way of checking if a site is using spam before exchanging links.

An new to SEO and would like to know before i make any mistakes. Thanks for your input in advance

Before linking, I'd do a couple of things. First, take a look at the site and check both for content your visitors will find useful and for the absence of any obvious spam techniques (hidden text, duplicate content, etc.)

Second, use the Google Toolbar to check the PageRank of the site. If the site is gray or PR0, then there is a chance that it is penalized. It could just be new, of course. I'd recommend waiting for a month or two in that case and re-checking.

While you are at it, be sure the page where you link is located on their site is easy to navigate to, and that the links are real links, not script redirects.

IMHO you should look at the source of the site in question, and the page that the link will be from, and if there is code that you wouldnt employ on your site then dont link with them.
