They're behind the times. In Canada, it's already legal to download music. The uploader could get in trouble I'm sure, but download? No problem, all very up and up and legal.

eskipii..It's way more complex than it seems regarding that particular ammendment and the legislation it seeks to adjust ..I alluded to it in the Sony rootkit thread a few weeks ago ..

I'll try and type up a precis of the situation for those who don't know about it ( virtually all the non fud has been posted in french on university and legal sites for months now ..Bloomberg has most of their information on this issue bassackwards as do nearly all the anglophone commentators ..they always think that school grade french or even a languages degree without living in the country means they can understand the nuances of language ) ..

I would have posted further on the matter in the Sony thread but

also I need to be carefull to avoid being
a) perceived as being "political"
b) entering too far into subjects the discussion of which might result in legal problems for Brett if the discussion gets too detailed on his fora

some last minute exterior rendevous to see to and I'll apply myself to the task ..

( I may well submit it to "premodding" via sticky to mods here prior to posting I don't know USA law well enough to avoid all potential pitfalls in such a discussion ..even treading carefully )

I don't think the RIAA ever went after a downloader, they are only going after the Uploader's.

I think the confusion is due to sloppy journalism.

If downloading music was illegal in the USA, and im not sure if it is, I think it would be a legal nightmare to prosecute.

Canadians pay some stupid tax on all blank media. This tax goes into a fund to be distributed to the artists who are getting screwed by people duplicating their music. (of course, last time I looked, not a penny of the millions collected had ever been distributed).

The tax creates some sort of quirky loophole that lets *me* make duplicates of music for my own use. I believe if you bring your Brittany Spears CD over to my place *I* can legally duplicate it myself, for my own enjoymemt. Same thing goes for downloads - I can download for my own purposes. It's a different story if you make the duplicate for me.

I know all this from trusted sources like linux user groups and local websites :).
