European Court: Worker Should Not Be Fired for Private Emails at Work

The European Court of Human Rights has overturned a ruling made in 2016 and has said that a Romanian man should not have been fired for sending private e-mails whilst at work.

However, his right to privacy had not been "adequately protected", the apex body of the European Court of Human Rights (ECHR) has now ruled.

The ECHR also said it was not clear whether Mr Barbulescu had been warned that his communications would be monitored, and that the original court had not established specifically why the monitoring had taken place. European Court: Worker Should Not Be Fired for Private Emails at Work [bbc.co.uk]

Sounds more like the methodology of how he was caught ended up being the reason why the verdict was overturned... and not necessarily setting any precedent for the allowance of emailing while at work.
