Can I charge less than what is owed?

I run a service where subscribers pay monthly... recently some of the credit cards have declined... can we bill... say half the amount that is owed to us for the services we already provided to recoup some of the $?

Why would you provide the service BEFORE you get paid? If this is what you are doing I would reconsider this entirely.

As for your original question, I would not charge them for a fraction of the cost; plus you don't know exactly why the credit cards are declining anyway so that might not even work. If they don't pay they don't get the service - period. Send out emails to those whose credit cards are declined telling them this. Note that the service will be suspended until complete payment is received.

I suppose they have a subscription contract with you. They owe you the full amount until they cancel the subscription. A declined credit card is not a cancellation of the contract.

I don't suggest partial charges. You agreed to a fixed subscription fee at a set interval. Get updated credit card details.

No, don't charge less just keep sending the statement, but intimate your willingness to accept monthly/weekly payments towards the bill.. if you get some of it back then that's better than nothing and often cheaper than a small claims court case.. it's likely what the bureaus would do anyway even if you did get the length of a small claim court -- oh and stop the service too unless it's now paid in advance ;)

You'd be surprised how many people do actually at least try to pay something when not threatened, even if they are in difficulty

Remind them of the overdue bills, then send the invoice again with added interest as per your legal entitlement and/or your contract. I find that when interest starts adding up, bills start getting paid.

Who said they were providing the service before they were paid?

Maybe they are billing in advance. Just because something is owed does not mean it is owed after the fact -- just that an agreement to pay was made.

simpleton3, most likely if the card was declined it means the account is closed due to non-payment or by the creditors request, or that it is expired. It is doubtful you would be able to charge a partial amount except in rare instances.
