I was going to link one cart to my merchant account directly then process transactions for the second site manually through the virtual terminal that comes with my merchant account, however this is not looking like an option anymore, my payment gateway is: ProTx
I will be informing all customers which name will appear on their bank statements etc. thats not a problem.
Also will welcome recommendations for shopping carts which can help with this.
Any help on this would be much appreciated!

Usually you give the processor what website you will be selling from and they approve it. The gateway (protx) is integrated into your website

could i get away with it
Sure, you could do it anyway. You should just keep in mind that regulations exist for a reason and circumventing them is not always the best idea unless you have an intimate understanding of why they exist in the first place.
The gateway in this case is really inconsequential. The issue is that you're bound to cause confusion for your customers resulting in an increased chargeback ratio for yourself and subsequently processor scrutiny.
I've set up many accounts where this has happened and I've seen every trick in the book to try and circumvent the regulations.
Aside from sites with very similar or identical DBA names selling the same product I have yet to see any of these methods yield a successful result.
