a customers buys but no response advice needed

there is a customer who bought a product from me but i realised later it was not in stock and offered him a refund or replacement but after 3 emails he did not reply so i called him on the phone in the usa but got some hispanic guy who does not speak english.its been 5 weeks now.. what should i do any advice.

cancel, refund and be done with it. There's not much else you can do if he doesn't cooperate. He probably forgot it too so don't worry.

Since we do not always know as a certainty what will be in stock when an order comes in we state that shipping dates are always approximate, so it becomes the customers responsibility to cancel their order if they no longer want an item.
