Taking an expired domain

Some while ago a business associate of mine took some of my ideas and opened up into comptetion. He is a bit dense about the internet and I see that his domain is about to expire. It would give me great pleasure to steal his domain and get some revenge. The question is would I be able to do this a midnight on the day it expires or would I have to wait a while?

Some registrars will hold a domain in expired status for up to six months.

The answer is no. It is very rare that that the DNS stops working and then the domains becomes available that close to each other. The registrar sort of gives a final notice by turning off the DNS. If the owner doesn't notice or care for a week or two then they are in danger of losing the domain.
