domain name copyright issue

i own a domain for exp.. exampleexample.com and it is my trademark registered most of the countries and doing successful business since long.

I got to know about 1 domain example4example.com 4 year old domain, which is also trading in the same industry on a small scale, not doing much business and very low rank site and all.

The owner of example4example.com has written on the site that they are example4example.com and doing this and that on the web. He does not have any thing written like exampleexample.com or exampleexample any where including disclaimer and about us pages.

Can i file a case against him for transfering the domain example4example.com to me as site must be confusing my site user to get business.

He is also not doing any PPC campaign on my name or even on his name, no banner on any name.

How does the UDRP forum act on these kind of issues...

You can raise a UDRP complaint but unless you can show bad faith, or make a case that visitors are confused (and believe they are dealing with you) then it is quite possible you will loose.

bad faith i can not prove as the domain is not using my exact name or brand, but can i collect fake visitors who can say that we have deal with this example4example.com site and then we cancelled bcoz we found that this is not the exampleexample.com..

example4example.com is growing slowely slowely and i doubt that it can be a competitor in near time 4 to 5 year down the time.

Is there any standing for this.....?
