a domain such as red-widgets.com is good for my busines niche but someone already registerd it but it expires soon, is it better for SEO reasons such as being less stuck in the sand box or be treated by the SE's better for being indexed, to wait to register the existing domain or create a new domain?

No difference if you register after it expires. A good name is always worth having, for the price. I'd suggest getting a new one to start now, and getting the generic keyword domain later when you can - either just for type-in traffic or for building a second site.

well the site thats registerd now is not really brandable but the product is a big business niche and its like red-widgets.com most main domain names for that niche are already registerd, i might get a new one myself with the .us domain like red-widgets.us and the one i plan to maybe get expires soon, the person who registerd it doesn't even have the site up they are thinking to keep it and maybe get an offer from someone.
