I'm wanting to try and get my hands on an australian domain name for a business that has recently finalized bankrupcy. I'm guessing that the next step for the company is that it is deregisterd with asic. The domain name in question is still appearing as being registered to the deregistered company. Does anyone know what happens in these sorts of situations? Does the auda have to release this domain? Do I contact the creditors or insolvency administrators?

If it's a .au domain name we're talking about, contact the .au registrar. But they'll likely keep it there for as long as it's registered, and could care less what happens to the registrant.

Then again, being a 3rd party, they likely won't tell you nothing, either.

If the company is in administration, try to contact the administrators and make them an offer.

Yeah, I'm currently trying to get onto them about this. But I have a feeling that insolvency has been finalized. Not that I know what I'm talking about at all. I mean, once a company has been deregistered, what happens to its assests? Do they remain in control of its administrators?

It's the administrators job to raise as much money as they can by selling the company's assets to pay back the creditors.

AUDA policy on Domain Sales [auda.org.au] is quote clear in that Australian Comains cannot be sold, although they are looking into the monetisation of domains in the future which may affect this.

Australian domains can be transferred [auda.org.au] but only under strict guidelines.

Either way, you will also need an ABN before any registration or transfer can take place.
