Domain Name Status on WhoIs Record: Disabled-due-spam

How to acquire a domain "Disabled due to spam"? Contact registrar? Will it drop?

I'm seeing this status on a domain I would very much like to acquire. It's obvious that the current registrant is a bad, bad email spammer.

Will this domain stay in this status forever? Can it ever be released? Will communicating with joker help?

Anyone had any previous experience with a similar situation?

I imagine "due process" requires some procedural niceties before they can release, resell or transfer the domain.
