Domain Trademark Claim?

Third party claims trademark on similar domain names.

Hi,

It has come my company's attention that a third party is attempting to register a trademark on a similarly named domain which was created after ours.

We do not have our name Trademarked, as of yet.

If they created this confusingly similar domain name several months after ours, does it still entitle them to the right to a trademark claim on that domain name if we both offer the same type of service?

Specific law advice won't be offered here, but your answer can be answered in general.

Most questions about trademark disputes hinge on how much you are willing to spend to defend your claim. That seems backward, but that's how the system works. I believe you can write the trademark office and appeal to them, but to take it farther will cost you.

You will need to talk to a lawyer for a better answer.

How is it that you know they are doing this?

The internet is not trademark friendly unless you have an international trademark which is kind of expensive. Copyright and trademark infringement will rise like weeds to be sure unless the governments get involved and maybe even if they are involved.
