4 years ago I registered a domian name of a product that was distributed in europe WITH INTENTIONS OF importing this product to america for sale. After 3 years of legwork, research and devolpment and failed negotiations with the manufacturer, I decided not to execute the contract. I have boxes of documentation to show that I was involved in a potential transaction directly with this company, including unexecuted agreements with their corporate seals and many other documents linking me to them. Not to mention that I registered the domain name one year before they registered the trademark name.
Now, one year later this company is distributing the product worlwide (including america) and have hired a high profile attorney to strip the name from me. I also own the .com, .net, .org, .info as well as many other names this company goes by.
I BELIEVE MY EVIDENCE SHOWS I AQUIRED THE NAME IN "GOOD FAITH"..PLUS THE FACT THAT THE COMPANY WAS NOT TRADEMARKED AT THE TIME I REGISTERED......I HAVE NEVER GONE ONLINE WITH ANY OF THESE NAMES....CAN THEY TAKE THEM FROM ME, OR ARE THEY MINE TO KEEP/SELL

Hello Olivia.

It's a bit of a sorry "welcome to WebmasterWorld" but the truth is we cannot possibly answer your question in any meaningful was without a) a great deal more specific information; and, b) law degrees and licenses likely issued by the controlling jurisdiction.

It's also true that anything you might publish here to "present your case" could very likely be used against you in legal proceedings.

As a matter of forum policy we don't allow threads to run where people seek specific legal advice. What makes the enforcement of that rule even more compelling is your advice that "the other side" has already retained legal counsel.

At this point I must advise you to seek private legal counsel in the jurisdiction that will be likely be chosen to resolve this issue.

This thread is now "locked", meaning that no further replies will be made.

Talk to an attorney. Immediately. Do NOT post any further details in public forums unless you are prepared to have an attorney or judge advise you that you have hung yourself on your own words. It could cost you dearly in some cases, so seek private, confidential legal advice.

Good luck.
