I know of several businesses who do not yet own their own name as a domain name. is it legal to buy and hold them in hopes of selling it to them down the line? Thanks for your help.

What you're proposing is a good way to get sued.

Invest your resources to find and develop domain names that don't infringe on other people's trademarks.

im not trying to be argumentative but I know tons of companies who buy and resell domain names, especially common mispellings. Heck, mispellings of my main domain name have been bought up and theres not much i can do about it. Is there a real legal basis for suing based on buying a domain name that is available?

Thanks for your help.

Deliberately buying a domain name that directly represents a company's name or other trademark / copyright is infrigement and the owner of it can sue you for the domain (plus any damages). Don't bother.

As for misspellings, you can go after them on similar grounds (cybersquatting).

Yes, you can register and own any domain you want, but if someone owns the copyright or trademark, then you might as well not bother.

what if there is no copyright but it is a business name.

For example, a name <snip> that is a descriptive word, is not trademarked and there might be 10 businesses with that name in the country.

what about those types of names?

Do you have any kind of contract as to who owns the name with your client?
