For the benefit of those just learning about this as they get into work Monday morning and don't have a lot of time to go searching all over the place for stuff, I am putting together this thread as a quick reference. For the benefit of our Monday morning friends, please keep discussion in the discussion thread [webmasterworld.com] and only post something here if you have links or information to add that would be useful for letter writers.

EXAMPLES OF CURRENT ABUSE (DOMAIN KITING)
Please note that these abuses are by registrars, but you can easily imagine that registries would want their piece of the action.

DEFINITIONS

REGISTRAR: A registrar is a company through which you register your domain. Examples include GoDaddy & Network Solutions. There are many competing registrars.

REGISTRY: A registry (a.k.a. registry operator) is the entity that manages a gTLD domain space. For example, the Public Interest Registry (PIR) manages the .ORG gTLD. There is only one registry per gTLD.

TLD: Top Level Domain. Examples are .BIZ, .INFO and .ORG.

gTLD: Generic Top Level Domain. Examples are .BIZ, .INFO and .ORG. (As opposed to a ccTLD, which are Country Code Top Level Domains, such as .US or .UK.)

WHO'S WHO

AFILIAS: Manages the .INFO gTLD.

ICANN: The Internet Corporation for Assigned Names and Numbers. ICANN "an internationally organized, non-profit corporation that has responsibility for Internet Protocol (IP) address space allocation, protocol identifier assignment, generic (gTLD) and country code (ccTLD) Top-Level Domain name system management, and root server system management functions. These services were originally performed under U.S. Government contract by the Internet Assigned Numbers Authority (IANA) and other entities. ICANN now performs the IANA function." See [icann.org ].

NEULEVEL: Manages the .BIZ gTLD.

PUBLIC INTEREST REGISTRY (PIR): Manages the .ORG gTLD.

ISSUES WITH THE PROPOSED AGREEMENTS

TIERED/VARIABLE BY DOMAIN PRICING
The proposed agreements eliminate pricing controls, including price caps, and allow for pricing on a per domain basis.
[forum.icann.org ]

IMPORTANT: It is important to note that tiered/variable by domain pricing is not specifically written into the agreements. The agreements eliminate pricing controls. This allows for registries to raise prices across the board without price caps or to raise prices on a per domain basis. This is an important distinction, so please bear that in mind when composing your message so that your message cannot easily be dismissed.

COLLECTION OF TRAFFIC DATA
The proposed agreements allow registries to collect traffic data for commercial purposes including "without limitation" promoting the sale of domain names.
[webmasterworld.com ]

PRESUMPTIVE RENEWAL
Agreements are automatically renewed with the registry and provisions relating to breach of contract in prior agreements have been eliminated.
See Section II: Policy Changes Proposed in the Agreements: [forum.icann.org ]
