Buying a Domain - Should I get a Trademark?

I am looking into buying a domain name. The site has a little info. on it. The site has not be checked by Google since January. Will this be a problem for me? I am looking into getting rid of all their site / info., and starting my own, but will it be hard to be updated by Google?

I checked and did not see any trademarks on the name either. If I buy it, would it be smart to get the trademark? Does anyone know how much getting a trademark costs?

As to trademark issues it's best you check with www.USPTO.gov about prices and general info. We don't offer legal guidance concerning what a member should do in specific circumstances, such as whether you should trademark you website name. Talk to a lawyer or, if you can't afford a lawyer, reveiw the USPTO office guidelines (if you are in the States).

The filing fee for a trademark is 330 per class. A lawyer will charge you anywhere from 500-1000 (on average), which include the fee.

Depending on the complicated nature of your service and mark, you can check out some comps and do it yourself. The main element of the mark is the decription with is about 2-3 sentence describing what you do.

TIP: Descriptive trademarks are very hard (and expensive) to overcome. That is, if they uspto deems the definition of the actual mark to close to what your description is.

EXAMPLE OF MARK THAT WOULD NOT PASS:

Name of mark: is 'The Furniture Store'
Description: a company that is a store that sells furniture

That would never pass.

EXAMPLE OF BETTER ATTEMPT:

Name of Mark: Oasis Living
Desciption: entity which provide customing interior design service and product inlcuding furniture, living supplies, and houseware
