acquire a domain thats bought with false details

Domain owned used false credit card details.

Hi

I own a domain which is like widget.com. Now some dude I was friends with bought widget.net which is similar to mine except for the extension and he used false credit card details to buy it. I am 100% certain. I always been aware of his previous activities of running spoof sites with trojans. He's running the site with similar content and he's serving trojans on certain pages.

Would I be able to take ownership of that domain and how? I manager to whois and find the registrator details but how would I be able to convinve them.

This dude is just someone I know throught he net.

Hi,

Sorry.No way to take the ownership of another domain without agreement with the owner.Moreover the unlawful ownership has to be shown before to carry out any action.It's penal law matter.

The person who controls the domain now doesnt own the domain legaly since its been bought with a stolen credit card thus not being on his name.

The domain is not rightfully paid by him. I should have the opportunity to pay for and take legal ownership shouldnt i?

Not exactly.
Once the domain is registered its not easy to change owner also if it is unlawfully owned.
As already said ,you should open a penal action showing that the domain is unlawfully owned.
And new ownership is decided by a sentence.

How would one take a penal action? Since I am a newbie in this field i'd appreciate some tips on how to make my move.

I was able to obtain the whois data and webhost.

"penal" means legal - that is, you need legal counsel to take penal action through a court. A public web forum like this is a lousy place to get legal advice - in fact, it would be against our policies to allow it.

How do you know he used a stolen credit card? I can see that youre upset over the replication of your website, but throwing accusations without solid proof will get you nowhere. I honestly do not see how you couldve possibly realize he bought a domain with a stolen credit card-was that card yours or something? Otherwise, how else would you know this information?

A public web forum like this is a lousy place to get legal advice - in fact, it would be against our policies to allow it.

Moreover this forum is "technical-oriented" while to take a legal action requires a lawyer consulting...

Thanks for questioning some of my answers guys.

I was friends once with this guy and I am aware of the sites he runs. None of his sites bothered me before till the day he decided to ride along with my websites fame.

He uses several domains to spread trojans and all of them
are registered on different names according to the whois database. Surely no one would buy this guy a domain so he can pursue his illegal activities. I also know his native nationality since we speak the same language and dont have such names Like "e.g John West, James Wood". The names of his credit card victims are not used in his country.

I was wondering what kind of penal action should I take? What kind of lawyer? If this is the wrong forum to ask no need to answer ;)

-Right now I am preparing a letter to report abuse to his webhost since its strictly in the webhosts T.O.S not to host any trojans.
-Writing his registrar about the credit card abuse and let them investigate it.

I am also avoiding the fact that he might know its me behind the closure of his website. I dont want any more trouble with him.

You are probably assuming he bought it with a fake credit card because his WHOIS info is fake. However, he probably used a real credit card but fake registrant info, which is different. It is against ICANN rules to use fake registrant info and if you know for sure that it is fake info you might try to report him to the registrar or ICANN and they might take action.

In addition you can do 2 more things. 1) If you own trademark on your domain you can file a domain dispute with ICANN which will cost you about $1500 but you will get the domain ownership. If you do not own trademark, I suggest you do it now and then file with ICANN.
