1 - Domain is active
2 - Domain expires. Registrar will delete the domain within 45 days.
3- Grace period. Registrar holds the domain name for an additional 30 days. During this time the original registrant can renew.
4 - Pending delete. The domain name will be released within 5 days.
5 - Available to purchase.
It sounds like your domain is in step 2 or 3. If it is a premium name, you will have strong competition for it.
Until the domain goes "pending delete", the original owner (for a fee) can recover the domain name. It will be hard, but if you can get the original owner to recover the domain and sell it to you thats your only other approach.

I was researching this for a .com domain name I want that has just expired after 5 years of non-use. According to the company I use for registrations, the period between expiry and sale is 60 days for .com domains.
So, try again in a week! :-)
