Parking Domain Name question.

Question: Since my Domain Name has been illegally transferred to another host by an unethical Webmaster, and it was paid up till 2007. I have noticed on the current WHOIS data that my Domain Name is still "Parked" at my former server.
The Unethical webmaster does not have access to my server password to change its current parked location.....
Will this prevent the sale of my Domain Name to another party should the Unethical Webmaster attempt to do so?

The question is not a matter of him controlling the DNS or the website. The question is does he control the whois information? If he doesn't control the whois information then he has little control over the domain. Yes, he can make changes people see, but you could cut him off by changing the DNS servers listed in the whois.

So, if i go to my server website, Log into my account, i can change the current DNS listed in the WHOIS and cut the sleaze off?...
This guy cannot seem to change the DNS in the WHOIS at this time. Eventhough he transfered my Domain Name the DNS info is the same as it has been since 97. If he could do it, he would have done it by now i would think.
Sorry, i am more of a pro-artist than a pro-webmaster.

Now that i have read more on this topic, I don't think the slime needs to change the DNS in the whois because he can do it at any time.
I lost controll of access to the WHOIS when he transfered my Domain Name.

SO,my next question would be: So why has this criminal not changed the DNS on the whois yet? I know he has his own server. Why not just take it all and change it to his home based server at this time?

First thing you should do is regain control of your domain, transfer it to another registrar. This will make sure you are the only one that has control to the interface at the new registrar.

Also you should tell the ex-webmaster to hand over the domain. Else if he is local to you. Take him to Small Claims court. Only costs like $25.

The reason he still has the old DNS on the WHOIS is that it takes 60 days before he can change the DNS during the 60 day transfer process.
As for small claims court, will not work. The guy now lives out of state. all his online address information and phone numbers are bogus....
Oh and by the way,...NSI is now not responding to my emails regarding this. My last email was to ask for a responce to my email from last week that had all my proof of ownership attached...Say who the hell are these guys? I have been with them for six years. I paid the $ for the use of my Domain Name every year. And now they will not email me the status of my claim? WHAT KIND OF BUSINESS ARE THEY RUNNING?
I am a artist. I don't have the $ to hire a $350.00 hour lawyer! THE THEFT OF MY DOMAIN NAME IS DISTROYING MY BUSINESS! Who helps people like me that have been defrauded by Internet crooks? Sure, i have read the ICCAN page. You need a lawyer to figure out all their rules and regs.

I cannot regain control of my Domain Name. The Crook that stole it has LOCKED IT, and changed the stupid contact email.
Its like robbing a bank with an email address instead of a gun!
Why is not NSI going after this crook?
He should be in jail for this fraud!
