Domain ownership - IPS TAG holder - ISP?

Might be thick, but... how to be in control of ones domains?!

I am in the UK, my domains are .co.uk.

I am in the process of changing my host after a painfull 4 months experience with the current one (they are is my second host)

At my request, my initial (first) host transfered my domains to the current one (host number 2) by transfering the TAGs of my domains to a new UK registar who is now my TAGs holder. (He is in the UK too)

This is the TAG Holder that my current (second) host recommended. I have had no personal contact with this Tag Holder, except emails I sent them, which came back saying that they won't answer since I was not one of their registered customer. Good start! (Seems to be an automated answer).

The Host I want to switch to is in the US.

My current Host is ok for me to leave without fuss and ask for the IPS TAG of my future US host.

My future US host sent me his name servers, advising to request to my TAG Holder the ownership of my domains. The TAG Holder, naturally, do not answer my emails.

Now, because of the massive difficulties ny current host seems to be in, it may take a few weeks before they get the TAG holder to register the change and switch me to the new nameservers of the US host.

I do not have the facility to do the change myself manually since my current host and my current TAG holder are two different companies. Apparantly, only my current host has authority to order the TAG holder to do the change of nameservers.

This is realllly getting onto my system.

Earlier on this year, Nominet told me that they were not a body that could act in the matter.

It is sort of stressing don't you think?

What would you suggest?

How can I handle this?

How can I gain ownership of my domains?
How can I change of TAG holder (I do not feel like staying with a TAG holder who does not answer my emails)

(I did not even know that my domains were owned by someone else...)

Does it make sens to anyone?

Hi Dom,

This is so typical situation.

To change IPS tag you should try to contact current tag holder. If they do not answer or do not help to resolve the problem, get on the phone to Nominet and they will help you with that.

This is so typical situation it makes me laugh but is dead serious for people who are in that situation.

Few words of advice: Don't keep your all eggs in one basket. You should have your domain name held by established domain name registrar and you can host wherever you want. You can change your host every week if you want, without any trouble.

Many web hosting companies are run by kids from there bedrooms. Not all able to keep up set standard of quality and customer support. So don’t trust your most valuable asset on the web - your domain name, to someone who you not really know or have track record.

The present problem seems now sorted and I will be able to do the change of host.

However, since my TAG holder - who I did not choose and who keep answering my emails with a 'we won't answer, as we can't find you as a register customer', does not want to communicate, I do not know how to change him to a reliable customer friendly TAG holding company.

I estimate my loss in income for these last 2 weeks
at several thousands of pounds. This this due entirely to my web sites being down for that period of time.

I can't believe that one cannot act against the host. If you have an idea about this, please advise.

It seems that hosts in their terms and conditions all insist saying that 'we ain't responsible for whatever consequences might result for you and/or for your business due to us being unable to do what you apy us for'.

Does anyone know of any specific law in this matter, protecting the client of a web hosting company if their web sites goes down for a certain period of time meaning proven lost of business?
I hate having recourse to justice - which seems to be quite unfair in the UK anyway, but there must be a code of ethics and proper laws preventing cow-boys to label themselves 'Web Hosting Company' while they are hardly learning how to use the keyboard of their computer...

For the most part, end customers holding .UK domains are steered clear of the actual administration of these domains. This is clear by the different pricing structures put in place by Nominet - if you have a tag-holder to look after your domain, renewal will cost them around £5 - if you're not a tag-holder and want to administer the domain yourself, then this goes up to £85 or thereabouts.

Not being able to get the current holder to change the tag isn't so much of a problem as Nominet have new proceedures in place - you'll find information regarding making the tag change yourself here [nominet.org.uk], although it will incur a one-off fee of £15.

If you want to complain about a tag-holder's behaviour, information about this is also on the Nominet site. You'll want to supply them with copies of correspondence sent the tag holder requesting the change though.

You can also get the new ISP TAG Holder to put pressure on the existing tag holder whatever the original tag holder require to release the domain send it to the new tag holder (it's usually a letter in this format on letter head paper)

We have registered the domain name yourdomain.co.uk with you and would like to transfer to a different ISP. Please release the isp tag for yourdomain.co.uk to New ISP , at your earliest convenience. Their tag is isptag.

once your new ISP has is letter he can start pestering the old tag holder and nominet
