Man drops lawsuit seeking deletion of arrest history from Google

A Japanese man has dropped a lawsuit seeking removal of his arrest history for child prostitution from Google Inc's search engine.

His decision comes after the Supreme Court earlier this year dismissed his demand on a separate provisional injunction made before the trial was concluded at the Saitama District Court. The lawsuit ended on Feb 24, according to the court record.

The top court said in January that the deletion of references can be allowed only when the value of privacy protection significantly outweighs that of information disclosure, in what is its first judgment in Japan that stipulates requirements for the approval of such a request.

Difficult to fight cross-rulings (meaning another court made an order in a related case). However, having a second ruling which defines parameters is going to impact future claims that follow the same concepts (defamation and privacy among others). Precedent has been set.

If the man was not convicted, it would seem he had a valid case of defamation since his arrest was unwarranted.

Since he was convicted, publishing his arrest record is just reporting facts and it would seem legit to include in search.

IMO he has no right to have his history forgotten. These are some of the consequences of his crime.
