Doing an abn search he was a sole trader and trading as "the domain name" ie. 'example', and the domain name is 'example.com.au'
Is there any way I can register the business name of 'domainname.com.au' and register it? Will this conflict with his trading name or trump it.

'AU' names are a little easier to get these days - you do need to have an ABN (Australian Business Number - free from the Australian Tax Office ; if you just have an ABN you 'trade' under your own name),,, and you need to explain why you needs the domain name.
For Example - if you were a plumber whose name was Bennie Benster (and you had an ABN) you could aply for bennietheplumber.com.au by explaining that your name is Bennie and you're a plumber...
If you were a plumber in Sydney, you could aply for sydneyplumber.com.au
If you were some guy who wanted to create an informative website on ugg boots - perhaps sell them... explain it to your 'AU' registra of choice and see if they give you the name.
For Example - if you were a plumber whose name was Bennie Benster (and you had an ABN) you could aply for bennietheplumber.com.au by explaining that your name is Bennie and you're a plumber...
But using the same ABN you could also get plumber.com.au, gasfitter.com.au, toiletbowl.com.au, brisbaneplumber.com.au, tapwasher.com.au, faucet.com.au etc, because you could explain that these were products you sold and you had a "close and substantial" relationship with these names. You would probably not get brisbanedentist.com.au.
