comparasion advertising?

Hi,

My competitor is using my name on his pages showing what we offer and how he ius better. This is the way , he show in the news papers also showing which feature we do not have . Though he use 4-5 competitor names. Now the problem, with our name also, his site is showing up. The title of the page he has used is comparasion of brand 1, his brand, our brand name etc etc.

can i legally ask him to stop.

Make your product better than his then he'll have to stop. :)

Seriously though, this isn't the place for legal advice. You see comparison advertising everywhere - on TV, in newspapers, on the Web, so I think it is pretty much accepted.

You would certainly have grounds to complain if he were misrepresenting your service to make his sound better.

There have been some discussions here about using comparison pages to get ranked for your competitor's name. Maybe your competitor read them! ;)

I doubt if you can make them stop doing it unless they are making false claims and you can prove it. If you have a lot more money than they do, of course, you can have your lawyers try to tie them up in knots anyway.

You might have a legal claim if they use your trademark in their meta-tags, though I feel these claims are kind of shaky.

Your best bet may be to get your own site ranked well, and consider striking back with your own comparison page.
