Selling software - who owns it

I recently sold a domain name and the script that runs it. No contract was made about the purchasers rights to the scripts. I plan to set up an online store, and a modified version of the scripts could be one of the products. Would it be legal (Canadian laws) to do this? Could I face potential lawsuits?

My take on it would be that his purchasing the website's software from me would be the same as him purchasing it from a store.

The question is whether you transferred ownership of the IP, or not. It's a shame you didn't address this in the contract. If you could get the other side to sign something now, saying that it's their understanding that you didn't transfer ownership in the software, you might have an argument that at the time of sale there was agreement between both parties that the rights in the software were not being sold.

Sounds to me like you need to talk to a Canadian IP lawyer though.
