Found my site mirrored by a different domain

Fairly recently while checking my logs,I noticed as the entry page, a particular domain name that I had not heard of.

On going to that domain,I was surprised to see my site in duplicate,and immediately went to WHOIS to check who owned this domain.
I however noticed that we had the same hosting company,and sent a mail to my host complaining about this domain.

A few days have passed and I have not yet heard from my hosts.
Was wondering what I should do next,and would appreciate suggestions in this regard.

I would take screen captures of the site in question. Try to get any dates on pages etc...and then run searches within WMW for past posts on the subject, I know there are quite a few. After that I would e-mail and perhaps snail mail the offending site with a cease and desist letter mentioning to them that your lawyer has been notified and will be reviewing their response.

The Digital Millennium Copyright Act (DMCA) requires that any ISP or service provider who wishes to benefit from the liability limitations included in the law, must register with the Copyright office as a service provider.

You can search for your hosting companies service provider registration information at:

[loc.gov...]

That will give you a specific contact name, email, and fax number for the person responsible for handling copyright infringement claims.

The DMCA contains some specific instructions on what you need to include in the email/fax you send, but it isn't really too complicated. You can get a PDF summary of the DMCA that explains what you need to do at:

Once you've completed the steps listed, contact your hosting company again and ask for the person listed in their service provider registration. That should get them to respond very quickly, because if they don't, they can potentially be held liable for the infringement.

Once the get your official request, the site should be taken down within 24 hours.
