Is IP messenger spamming covered under the new spam laws?

I am wondering if the new spam laws protect against IP spamming? You know those prompts that pop up with a message. Is that method covered and illegal?

I haven't seen anything that directly applies. Of course, the courts can make decisions that interperet laws on a wider basis, but I haven't read any of that either.
