I got a spam email at a non-existant email address from my site (I have a catch all bucket). The bottom says:


This mailing has been performed by COMPANY,
ADDRESS, ANYWHERE USA,
in compliance with the "CAN-SPAM Act of 2003",
approved and signed by the president of
The United States of America on Dec. 16, 2003.
For this reason, this email cannot be considered SPAM.

Right... How did you get my email address if it isn't even actually an address? Not spam? Sure... I have a bridge to sell as well.

It's spam. Whether or not it is illegal is another question (I suspect that it is), but it is still spam.

This e-mail cannot be considered spam? Then why do they feel they have to explain?

"This e-mail cannot be considered spam" and variations thereof is a very good phrase to add to a spam filter, actually.

It's not from a hostingprod.com site is it? It looks like the standard disclaimer they use.

hostingprod.com is the bulletproof hosting run by Yahoo! They never terminate anybody and are happy for their clients to spam away under the pretence that's it's opt-in.

Hostingprod it is. The spammer is using various web sites there and mangling the URLs:

I received over 50 in the last 10 days, all sent to various domains as contacts@one-of-my-domains.com

This same spammer has been operating for over two years, and now he's trying to wrap himself in the CAN SPAM act. But the e mails are in violation of the CAN SPAM act if for no other reason than the Earthlink addresses used by the phony "Sender" are forged.
