Meta-search legality issue?

Does anyone use Google's co-op Custom Search thing?

This question is so basic (probably because I'm new to site design and just learning the basics), but I really want to know how it is that metasearch engine sites like: dogpile, mamma, jux2, clusty and so on can combine the BIG search engines like Google and Yahoo and Ask.com and return compiled results?!? I have read the Terms of Use for the services that Google/Yahoo/ask offer and it doesn't jive with the way these meta-search sites use the Service.

How is this possible? Are special arrangements/agreements/contracts made between Google et al and the likes of dogpile and jux2? And if so, HOW? I spent 3 days on the phone trying to speak to anyone that even works at Google or Yahoo. Needless to say, I got nowhere.

I know this might not be the proper place to post a question like this since I offer nothing to spurn good webmaster conversation, but I'd really appreciate any help I can get!

I don't think the 'special arrangements' or contracts is happening.

Also, I don't understand by it not complying with the TOS? - anyone can use googles search api to compile search results.
