Unsubscribe Link - Legalities

Hi all

I have been spammed heavy today from one company and the emails do not even supply an unsubscribe link. I know it's bad to click them but what is the legal position NOT to include a unsubscribe link?

How can you unsubscribe from it if you never subscribed to it, in the first place. If it was opt in then woulden't be spamm.

Never click on any with an opt out though, just confirmes your email address is live.
